The Massachusetts Department of Public Health (DPH) is resharing statewide guidance released in May by the Healey-Driscoll Administration regarding interactions with U.S. Immigration and Customs Enforcement (ICE) agents in health care organizations.

This guidance was required under Executive Order 650, signed January 29, 2026 and is intended to help health care facilities and other organizations protect access to essential services, understand their rights and responsibilities, and prepare staff to respond appropriately if federal immigration officers arrive on site.

DPH is sharing this guidance to all licensed healthcare organizations to support continued consistent, lawful, and patient-centered implementation across the Commonwealth's health care system. Additional information including the guidance documents may be found here. Mass Senior Care has also created and distributed a toolkit for nursing facilities on interacting with law enforcement including ICE. MSCA encourages employers to review these documents and ensure your organization is prepared.
