As anticipated, the U.S. Department of Homeland Security (DHS) has issued federal register notices terminating Temporary Protected Status (TPS) for four countries, with the changes taking effect in early 2026. The countries and termination dates are as follows:
- South Sudan: January 5, 2026
- Burma (Myanmar): January 26, 2026
- Haiti: February 3, 2026
- Ethiopia: February 13, 2026
Mass Senior Care (MSCA) and our members have been closely monitoring federal immigration policy developments and is deeply disappointed that the end of TPS for Haitians will result in the loss of approximately 2,000 senior living employees, the majority of whom serve in Certified Nursing Assistant (CNA) roles.
Once TPS terminates for each country, associated Employment Authorization Documents (EADs) will no longer be valid, unless an individual has obtained an alternative immigration status or work authorization.
Given the potential impact on staffing and continuity of care, MSCA strongly encourages member facilities to review their workforce needs, consult with legal counsel as appropriate, and develop contingency plans to mitigate possible disruptions in resident care and operations. Please note, CMS Emergency Preparedness Regulations require facilities to develop and maintain a staffing strategy to address potential workforce shortages as a component of their emergency preparedness plan.
