
On May 19th, the U.S. Supreme Court, in an emergency order with only one noted dissent, authorized the termination of Temporary Protected Status (TPS) for nearly 350,000 Venezuelan immigrants currently residing in the United States. This decision overturns a prior ruling by a federal judge in San Francisco, who had blocked an effort by Homeland Security Secretary Kristi Noem to end TPS protections for Venezuelans. Following the lower court's decision, former President Trump petitioned the Supreme Court to intervene.
TPS is a humanitarian designation granted to nationals of countries experiencing armed conflict, environmental disaster, or extraordinary conditions that make return unsafe. Venezuelans represent the largest group of TPS holders in the U.S. The Supreme Court’s decision has consequences beyond the Venezuelan community as this ruling may set a precedent that extends to the rollback of Haitian TPS currently set to expire on August 3, 2025 and the pause that was placed on the end of CHNV parole by a U.S. District Court judge in Boston.
