Public Health Emergency CMS Flexibilities Update

On January 30, 2023, the Biden-Harris Administration announced its intent to end the national emergency and public health emergency (PHE) declarations related to the COVID-19 pandemic on May 11, 2023. The Centers for Medicare & Medicaid Services (CMS) has resources available to help nursing facilities prepare for the end of the PHE, some of which have been updated based on recent action by Congress. Nursing facility providers are encouraged to read the full CMS document  Long-Term Care Facilities (Skilled Nursing Facilities and/or Nursing Facilities): CMS Flexibilities to Fight COVID-19  to understand the impact of the end of the PHE. Mass Senior Care is working with AHCA to advocate for the extension of certain flexibilities including the 3-day waiver.
