On July 14, 2025, the Executive Office of Health and Human Services (EOHHS) issued Administrative Bulletin 25-16 updating the fees effective July 1, 2025 for fiscal year 2026. This change implements the new state budget requirement that EOHHS increase the nursing facility provider tax to the maximum amount under federal law, which totals 6% of total annual nursing facility revenue.

In response to Mass Senior Care’s concern about cash flow issues arising from implementation of the new FY26 User Fee rates in July while the Medicaid nursing facility rate increase will not take effect until October 1, 2025, EOHHS agreed to not assess interest and late fees for a facility that did not pay its user fees for July 1, 2025 – September 30, 2025 on time. All other enforcement procedures described in 101 CMR 512.00 and Administrative Bulletin 23-01 remain in effect.
