DONs Encouraged to Participate in Harvard School of Public Health Survey

The National Institute for Occupational Safety and Health has given the Harvard Chan School of Public Health Center for Work, Health, and Well-being a grant to study health, safety, and wellness in the nursing home industry. Harvard is collaborating with Massachusetts Senior Care on the study, Enterprise Outcomes, in Massachusetts. The first part of Enterprise Outcomes is a survey of Directors of Nursing. The Department of Family and Medical Leave has issued draft Paid Family and Medical Leave (PFML) regulations. The regulations are posted on the Department’s website . OIG LEIE Database Updated for December 2018

The US Department of Health and Human Services, Office of Inspector General (OIG) has released its updated list which reflects all OIG exclusions and reinstatement actions up to, and including, those taken in December 2018. This new file is meant to replace the updated List of Excluded Individuals/Entities (LEIE) database file available for download last month. Individuals and entities that have been reinstated to the federal health care programs are not included in this file. The updated files are posted

Peg Stearns Celebrates Her 108th Birthday at Life Care Center of Wilbraham

Peg Stearns celebrated her 108th birthday on January 5th at Life Care Center of Wilbraham. Joining in Peg’s festivities were special guests U.S. Congressman Richard Neal, State Senator Eric Lesser and State Representative Angelo Puppolo. Nursing Centers Action Plan Response for Adverse Event

The American Health Care Association’s (AHCA) Survey/Regulatory Committee has developed tools to assist nursing homes in addressing adverse and potential adverse events. These tools will assist nursing homes in documenting and tracking the steps that have been taken, and identification of best practices for ongoing improvement. Use of these tools does not guarantee regulatory compliance nor mitigate potential liability. 2019 Direct Care Staff Payment Update: (1) Second Payment and (2) Updated FAQ

The SFY 2019 budget act authorizes the Direct Care Staff Payment at $38.5 million, a $2.8 million increase from the prior fiscal year. EOHHS Certifies 2nd Component of FY 2019 Medicaid Rates and Issues PASRR Billing Instructions: Short Term Stabilization Plan

The Executive Office of Health and Human Services (EOHHS) has adopted the second component of the FY 2019 Medicaid nursing facility rate regulation, focusing on (1) quality achievement and (2) PASRR add-ons. The two new add-ons are effective on January 1, 2019. In combination with the October 1, 2018 Medicaid rate increases, these actions total $31 million and represent EOHHS Secretary Marylou Sudders' first step in a short-term stabilization package. Reporting Seasonal Influenza Vaccination of Healthcare Personnel (HCP) for the 2018-2019 Influenza Season

Nursing Homes and Rest Homes are required by regulation to report healthcare personnel (HCP) influenza data to the Department of Public Health by April 15, 2019. The Department of Public Health has provided guidance for facilities to fulfill the requirement. Grassroots Advocacy Focuses on Governor's FY 2020 Budget

Governor Charlie Baker and Lt. Governor Karyn Polito were sworn-in for a second term this past Thursday and are actively working to finalize their FY 2020 budget recommendation, which is due on January 23rd. Martha’s Vineyard Hospital Seeks Partner to Redevelop its Windemere Nursing and Rehab Center

Martha’s Vineyard Hospital (MHV) has released a Request for Information (RFI) to identify potential partners. MVH is looking to relocate Windemere to another location on the island of Martha’s Vineyard and is most interested in having an innovative model of long term care. MassHealth NF Census Survey Electronic Filing: Reminder to Complete January 1, 2019 Filing

MassHealth electronically collects nursing facility census data information quarterly, and is currently collecting census form filings for January 1, 2019. MassHealth issues an e-mail to an individual designated by the nursing facility to complete the form, typically to a contact person in the business office. If your facility has not yet filed the January 1, 2019 census form with MassHealth, we urge you to complete the census form and file electronically. This week, Governor Charlie Baker, Lt. Governor Karyn Polito and members of the 191st Massachusetts Legislature were sworn in to their respective terms in office at the State House on Beacon Hill. Department of Public Health Issues Circular Letter on Beds Out of Service (BOOS)

As part of an overall effort to review and modernize the longstanding moratorium on new long term care facility beds, the Department of Public Health on December 11, 2018 issued a Circular Letter indicating that the Department will no longer grant approvals for beds out of service (BOOS) in previously closed buildings.

Public Health Council Adopts Revised Amendments to Determination of Need Regulations

The Public Health Council last week adopted amendments to the Department of Public Health’s Determination of Need (DoN) regulations which were significantly revised in 2017. In operationalizing the 2017 DoN regulation, DPH identified areas that required clarification to improve implementation. In updating the regulations, DPH again affirmed that nursing facilities with DoN approvals prior to January 2017 will be permitted to implement the projects, as originally approved. Secretary of Elder Affairs Bonner Announces Departure

After three and half years as Secretary of the Executive Office of Elder Affairs, Alice Bonner is returning to her roots in healthcare and nursing education in late January. Clarification on Multi-Drug-Single-Dose Packaging

In response to member questions regarding multi-drug-single-dose packaging of medications, Mass Senior Care staff met with the Department of Public Health's Associate Commissioner, Director of the Boards of Professional Licensure and DPH Legal Counsel to obtain clarification on this issue. The Department of Public Health confirmed that multi-drug,-single-dose packaging is not prohibited in the long-term care setting. DPH to Upgrade Mass. Health Professions License Verification Website

DPH is planning a system upgrade to the Massachusetts Health Professions License Verification Site beginning Friday, December 28, 2018 through Monday, January 7, 2019. During the system upgrade period, DPH does not anticipate any disruption in service for providers using the license verification site to check the status of a certified nurse aide (CNA). Nursing home industry sounds alarm

THE MASSACHUSETTS NURSING HOME INDUSTRY says inadequate state funding caused 20 facilities to close last year and is putting another 39 at risk of going out of business this year.
