On Friday, March 29, 2024, the amended 651 CMR 12.00: Certification procedures and standards for assisted living residences regulations were published by the Secretary of State’s office and became effective immediately. The amended regulations include the following changes:
- A Residence cannot require personnel to receive a vaccine or if the individual declines the vaccine.
- The individual who is exempt from vaccination shall sign a statement certifying that they are exempt from vaccination, and they received information about the risks and benefits of influenza vaccination and COVID-19 vaccination.
- Individuals subject to the exemption, the Residence shall require the individual to take mitigation measures, consistent with guidance from EOEA.
- In addition, nothing in amended regulations shall prohibit facilities from establishing policies and procedures for influenza and COVID-19 vaccination of personnel that exceed the requirements set forth in 651 CMR 12.06(8).
- The requirement that all persons working in a Residence complete a pre-employment physical examination, including an assessment for tuberculosis, and submit evidence that they have completed a periodic physical examination at least every two years has been removed from the regulations.
